Fraksi PKS DPR (FPKS) masih menolak draft RUU Ormas yang diajukan pemerintah. FPKS menilai ada beberapa pasal yang harus diubah.
Anggota
Pansus RUU Ormas dari Fraksi PKS, Indra, mengatakan ada dua poin utama
yang ditolak oleh PKS. Dua poin itu adalah asas tunggal dan kewenangan
pemerintah menghukum suatu ormas tanpa melalui pengadilan.
“Masih
ada dua substansi lagi yang masih belum menemukan kesepakatan bulat.
Pertama, FPKS tetap menolak asas tunggal. Kedua, FPKS tetap menolak
penghentian sementara menjadi kewenangan (subjektif) pemerintah. FPKS
menginginkan penghentian sementara melalui pengadilan,” kata Indra saat
berbincang, Rabu (3/4/2013).
Salah satu pasal di RUU Ormas memang
mengatur kewajiban menggunakan asas tunggal bagi ormas-ormas yang ingin
hidup di Indonesia. Asas tersebut adalah Pancasila dan Undang-undang
Dasar 1945.
Mengenai hal ini, Indra mengatakan FPKS ingin
ormas-ormas diberi kebebasan menentukan asasnya sendiri. Asal, asas
tersebut tidak bertentangan dengan Pancasila dan UUD 1945.
“FPKS
konsisten bahwa Pancasila diposisikan sebagai asas negara, sedangkan
ormas mengunakan asas yang tidak bertentangan dengan Pancasila & UUD
45,” ujarnya.
“Jadi redaksi dalam RUU Ormas usulan FPKS ‘Asas
Ormas tidak bertentangan dengan Pancasila & UUD 45,” tambah pria
yang juga anggota Komisi III DPR ini.
Poin lain yang menjadi
keberatan FPKS, adalah pasal yang mengatur kewenangan pemerintah
menghentikan kegiatan suatu ormas tanpa melalui pengadilan. Indra
menyebut pasal itu berpotensi disalahgunakan oleh pemerintah yang
berkuasa nantinya.
“FPKS menginginkan agar penghentian sementara
menjadi kewenangan pengadilan. FPKS memandang kewenangan subjektif
pemerintah dalam menghentikan kegiatan ormas berpotensi represif,”
ujarnya.
“Sanksi penghentian kegiatan dan pembubaran tidak boleh
menjadi kewenangan sepihak pemerintah, namun harus melalui mekanisme
putusan pengadilan. Hal ini sejalan dengan asas hukum praduga tdk
bersalah dan dalam rangka menghindari kesewenang-wenangan rezim,” imbuh
