PERJALANAN sejarah perjuangan umat Islam akhir-akhir ini mencatat,
bahwa gerakan Islam memiliki potensi cukup besar untuk memenangkan suara
mayoritas melalui pemilu demokrasi. Akan tetapi, kemenangan tersebut
menjadi tidak efektif setelah kekuasaan itu diraih. Kemenangan FIS di
Al-Jazair pada era 90-an sebagai contoh, begitu mudah dianulir pihak
militer. Begitupun kemenangan Najmuddin Erbakan di Turki. Jauh
sebelumnya, kemenangan Masyumi di Indonesia hingga meraih kursi Perdana
Menteri.
Dan yang paling baru, kemenangan Ikhwanul Muslimin di
Mesir. Belum genap setahun berkuasa, pemerintahan Presiden Mursi
ditumbangkan secara illegal melalui kudeta militer.
Menyaksikan
fakta ini, cukup menarik mengikuti perbincangan A. Hassan dengan PM
Moh. Natsir yang diceritakan pada Muhammad Thalib, tahun 1968, oleh
almarhum Abdullah Musa, penanggungjawab Majalah Al-Muslimun dan menantu
A. Hassan.
A. Hassan mengatakan, ” Setelah Sukarno meraih
kekuasaan menjadi Presiden RI dia berani lansung menghantam dan
mendiskreditkan Islam. Tetapi mengapa ketika Natsir menjadi Perdana
Menteri, tidak berani membela Islam dan menghantam lawan lawan Islam?
Karena takut dituduh tidak demokratis oleh Barat.”
Kelemahan
tokoh-tokoh Islam, takut dituduh anti barat dan tidak demokratis. Sibuk
dengan kesan orang kafir, padahal rezim kuffar dimanapun tidak pernah
mempertimbangkan eksistensi Islam dan umat Islam dalam menentukan sistem
pemerintahan apa yang akan mereka jalankan.
Sikap yang sama berulang lagi pada Presiden Mursi. Dalam suatu wawancara dengan media Prancis
Le Monde,
seminggu setelah dilantik sebagai Presiden Mesir. Pewawancara
menanyakan: “Apakah Ikhwanul Muslimin akan menjadikan Mesir sebagai
negara agama?” Presiden Mursi menjawab: “Mesir tidak akan menjadi negara
agama.”
Ini membuktikan, bahwa Mursi tidak mau berterus terang
menghadapi kaum sekuler, mungkin takut dituduh anti demokrasi. “Berani
melecehkan Islam, tapi takut melecehkan demokrasi” merupakan sikap umum
sebagaian besar tokoh-tokoh Islam.
Intervensi demokrasi sudah
sedemikian jauh menyusup ke relung hati sebagian tokoh Islam, dan
mengotori aqidah serta pemahaman agama kaum Muslim. Tidak sedikit yang
berpendapat, demokrasi tidak bertentangan dengan prinsip-prinsip Islam.
Lalu, sadar atau tidak sadar, mereka tampil sebagai bemper demokrasi,
menjadikannya sebagai barometer politik dan ideologi.
Makna harfiyah demokrasi, sebagai pecahan dari dua kata
demos (rakyat) dan
kratos (kekuasan) adalah kekuasaan rakyat. Inilah makna essensial dari demokrasi, yaitu kekuasaan berada di tangan rakyat. Termasuk
tasyri’ul jamaahiir
(wewenang membuat hukum) tergantung suara mayoritas rakyat. Sebagai
sistem hidup dan tatanan politik dalam bernegara, demokrasi tidak
memiliki sumber hukum, tidak punya kitab suci, apalagi Nabi, semuanya
tergantung kehendak dan hawanafsu rakyat, yang disampaikan melalui
wakil-wakilnya di parlemen.
Prinsipnya adalah, kedaulatan
tertinggi berada di tangan rakyat, suara rakyat adalah suara Tuhan.
Kemauan rakyat mayoritas merupakan hukum tertinggi dalam merumuskan
undang-undang; sedang kebenaran tergantung kehendak mayoritas. Mengapa
kaum demokrasi tidak menggunakan akalnya? Jika suara rakyat adalah suara
tuhan, mengapa suara tuhan begitu mudah dibeli dan dimanipulasi pada
setiap Pilpres, Pilgub dan Pilkada?
Sesungguhnya Islam
mengajarkan, bahwa kedaulatan tertinggi berada di tangan Allah Swt.
Islam mengajarkan untuk beribadah dan berserah diri hanya kepada Allah
saja. Sebagai tatanan politik bernegara, Islam memiliki sumber hukum,
yaitu Qur’an dan Sunnah Rasulullah Saw. Hukum buatan manusia disebut
Undang-undang, dan hukum ciptaan Allah disebut SYARI’AT. Implementasi
dari Hukum Qur’an dan Hadist, inilah yang seharusnya dilaksanakan oleh
manusia dalam segala aspek kehidupannya.
Kontroversi di kalangan
umat Islam, sesungguhnya dipicu oleh dua hal ini. Apakah dalam
menyelenggarakan kekuasaan Negara, umat Islam ‘beriman pada konsep
kedaulatan rakyat (demokrasi)’ dan menolak konsep kedaulatan Allah Swt
(Islam), atau sebaliknya menolak konsep demokrasi secara totalitas dan
menerima konsep Islam secara totalitas pula? Atau memilih opsi
oportunistik, memadukan demokrasi dan Islam, menolak sebagian dan
menerima sebagian ajaran Islam, seperti yang dilakukan orang-orang kafir
ahli kitab yang dimurkai Allah?
“Apakah kamu beriman kepada
sebagian Alkitab dan ingkar terhadap sebagian yang lain? Tiadalah
balasan bagi orang yang berbuat demikiandaripadamu, melainkan kenistaan
dalam kehidupan dunia, dan pada hari kiamat mereka dikembalikan kepada
siksa yang sangat berat. Allah tidak lengah dari apa yang kamu perbuat.” (Qs. Al-Baqarah, 2:85)
Terhadap
kenyataan ini, semestinya umat Islam, baik yang berada di dalam parpol
atau ormas Islam tidak boleh terlena dan lengah. Apa jadinya jika atas
nama demokrasi, lalu menghalalkan apa yang diharamkan Allah dan
sebaliknya? Ada kesan, bahwa parpol Islam justru menjadi bemper
demokrasi. Dalam banyak kasus, parpol Islam justru diperalat oleh
demokrasi untuk menghambat syari’at Islam. “Boleh saja Islam berperan
dalam membangun masyarakat, sejauh tidak bertentangan dengan demokrasi,”
alasan mereka.
Buruknya ideologi demokrasi bagi kehidupan
berbangsa dan bernegara, karena menghalalkan apa yang diharamkan Allah
dan sebaliknya, bagai anak anjing yang tidak menaati induknya. Seperti
sebuah analogi di bawah ini:
“Suatu ketika, seorang laki-laki
dari bani Israil kedatangan tamu, sedang di rumahnya ada seekor anjing
yang hamil tua. Berkatalah anjing itu, “Demi Allah aku tidak akan
menggonggong kepada tamu tuanku”. Tiba-tiba anak yang dikandungnyalah
yang menggonggong. Tuan rumah, si pemilik anjing berkata (kepada
seseorang), “Alamat apa ini?” Kemudian Allah memberikan ilham kepada
seorang laki-laki di antara mereka, “Ini adalah permisalan bahwa, akan
ada umat sesudahmu, orang-orang bodoh dapat memaksa orang-orang yang
pandai dan bijak di antara mereka.”
Analogi ini bersumber dari
Abdullah bin Amr yang termuat di dalam kitab Jami’us Shaghir 5204.
Maksudnya, bahwa proses mencari, memilih dan menetapkan seorang pemimpin
menurut versi demokrasi adalah; siapa yang mendapatkan dukungan
terbanyak maka ialah yang patut duduk sebagai pemimpin. Dan suara
terbanyak sama artinya dengan siapa yang banyak omong. Alkisah
orang-orang bodoh suka membuat gaduh dengan beramai-ramai bersuara
keras, berkampanye, bahkan
money politic, sehingga suara maupun
pemikiran orang-orang pandai, cerdas, dan shalih tidak terdengar karena
tenggelam dalam riuhnya suara si bodoh (anjing) yang ber-uang. Ketika
tipu daya orang-orang jahat dapat mempengaruhi masyarakat awam, maka
orang-orang jahat pun akan dapat mengalahkan orang-orang baik. Itulah
demokrasi yang menganggap suara mayoritas sebagai tuhan (kebenaran).”
Tragisnya,
sebagian besar penganut Islam tampaknya merasa amat sangat bersyukur
–bukan bersedih- Indonesia diatur dengan sistem demokrasi, sehingga
beramai-ramai menolak syari’at Islam. Mereka menganggap demokrasi
sebagai pemersatu dan penyelamat, sedangkan syari’at Islam diposisikan
sebagai ancaman dan pemecah belah rakyat.
Ucapan dan rasa syukur
itu diungkapkan, misalnya oleh Presiden Susilo Bambang Yudoyono dalam
orasi pengukuhan sebagai Capres 2009: “Saya bersyukur kepada Allah Swt,
keluarga saya diatur dengan demokrasi, sehingga setiap orang dalam
anggota keluarga saya bebas berpendapat,” katanya bangga.
Kontra Syari’at Islam
Pertarungan
antara yang haq dan bathil merupakan sunnatullah. Sedangkan upaya
mensinergikan antara keduanya, adalah program syetan. Oleh karena itu
Islam dengan tegas menolak sinkretisasi/oplos kebenaran dan kebathilan
sebagaimana firman-Nya:
“Dan janganlah kamu campur adukkan
yang hak dan yang bathil, dan janganlah kamu sembunyikan yang hak itu
sedang kamu mengetahui.” (Qs. Al-Baqarah, 2:42)
Pada tataran
ideologis dan praktis, pertarungan yang terjadi sekarang bukan hanya
antara Muslim dan Non Muslim, justru antara Muslim yang mendukung dan
anti formalisasi syari’ah. Proses syetanisasi di negeri ini, tidak
hanya dimonopoli orang kafir; tetapi berlangsung secara legal, formal,
dan konstitusional. Seperti dikatakan sekte JIL (Jaringan Islam
Liberal), “Kita menerima ideologi demokrasi, karena demokrasi
mensinergikan antara yang baik dan buruk, halal dan haram.”
Kelompok
anti syari’ah Islam meyakini bahwa demokrasi lebih tepat bagi bangsa
Indonesia, karena bisa mensinergikan antara halal dan haram sesuai
kebutuhan. Akibatnya muncul sikap ambivalen dan munafik.
Pada
masa Orde Baru kekuasaan politik memang cenderung represif pada Islam
karena dianggap menjadi salah-satu potensi ancaman pada rezim yang
sedang berkuasa. Upaya sistematis dilakukan oleh kekuasaan formal untuk
menekan gerak sosial-politik umat Islam termasuk pemberian cap ‘ekstrim
kanan, subversi, radikal, teroris dsbnya,’ yang ujung-ujungnya menekan
aktifis Islam untuk tidak bisa bergerak maju dalam bidang
sosial-politik.
Partai politik yang berasas Islam pun secara
sistematis diseret ke arah meninggalkan asas Islam, demikian pula dengan
ormas Islam sekalipun yang akhirnya merubah asas Islam menjadi asas
lain. Masalahnya, apakah dengan mimikri politik seperti itu Indonesia
menjadi lebih maju dan berjaya? Kerusakan masyarakat terus saja
bertambah di atas kerusakan yang sudah menggunung.
Lalu, mengapa
ada sejumlah tokoh Muslim, bahkan dari kalangan orang-orang yang
menyatakan diri sebagai pembela Islam, justru menolak formalisasi
syari’at Islam? Mengapa terdapat hamba Allah yang membangkang kepada
Allah Swt? Apa sesungguhnya dasar berfikir yang melatarbelakangi mereka
menolak syari’at Islam?
Menurut pengalaman bertahun-tahun di
arena perjuangan, dan fakta sosial di masyarakat, faktor penyebabnya
antara lain: di kalangan kaum Muslimin, muncul kesan bahwa menegakkan
kehidupan berbasis Islam merupakan ancaman terhadap keselamatan diri di
tengah berlangsungnya globalisasi politik, ekonomi, budaya dan
globalisasi agama. Hal ini tercermin pada keengganan mereka untuk
berterus terang dengan agamanya, dan dengan terpaksa menerima
stigmatisasi musuh-musuh Islam; bahwa Islam adalah agama yang telah
kehilangan relevansi untuk terus dipertahankan di era globalisasi ini.
Padahal Allah Swt telah menginformasikan melalui firman-Nya:
“Thaaha,
Kami tidak menurunkan Al-Qur’an ini kepadamu agar kamu menjadi susah;
tetapi sebagai peringatan bagi orang yang takut kepada Allah, yaitu
diturunkan dari Allah yang menciptakan langit dan bumi yang tinggi.” (Qs. Thaaha, 20:1-3)
Selain
faktor di atas, banyak kalangan Muslim yang memosisikan Islam selaras
dengan demokrasi. Sehingga, ketika mereka melakukan amal-amal demokrasi
berlandaskan kedaulatan rakyat dan tunduk pada suara mayoritas, mereka
ingin perbuatannya itu dilabeli merk ‘Islami’. Padahal, tidak semua
ajaran demokrasi sesuai syari’at Islam, sebaliknya apa yang sesuai
dengan syari’at Islam dianggap tidak demokratis.
Jika Islam yang
dimaksud seperti yang dipahami kebanyakan orang Islam yang anti syari’at
Islam, atau menerima sebagian dan menolak sebagian dari ajaran Islam,
mungkin dapat diselaraskan dengan demokrasi. Tetapi jika Islam yang
dimaksud seperti yang diwahyukan Allah dan diajarkan oleh Nabi Muhammad
Saw, mustahil bisa dicocok-cocokkan. Sebab Islam berdiri tegak di atas
landasan Tauhid, sedang demokrasi berdiri tegak di atas landasan hawa
nafsu. Islam memiliki sumber hukum (Qur’an dan Hadits), sedang demokrasi
sumber hukumnya ‘kemauan orang banyak’. Islam mengharamkan daging babi,
khamer, pelacuran, perjudian, ekonomi ribawi, sedang demokrasi
menganggap kemaksiatan dan kemungkaran sebagai fasilitas hidup.
Barangkali
benar, bila dalam menjalani kehidupan ini seorang Muslim tidak memiliki
ukuran atau barometer ideologis yang jelas, sikap dan pernyataannya
kerapkali kontraproduktif. Seperti ucapan Prof. Dr. Yusril Ihza Mahendra
(Ketua Majelis Syuro PBB), pada Ahad, 16 Shafar 1431 H/ 31 Januari 2010
M, dalam suatu dialog dengan penulis, di hadapan Musywil Partai Bulan
Bintang, Jawa Timur, Surabaya.
“Demokrasi tergantung ta’rif mana
yang digunakan, karena makna demokrasi itu banyak, tidak tunggal.
Perbedaan amal demokrasi atau amal Islami, mungkin saja dirasakan oleh
mereka yang bergelut di bidang teori, tapi bagi yang bergelut secara
praktis dan pengambil keputusan, tidak merasakan adanya konflik ideologi
seperti itu. Apakah ini amal Islami atau aktivitas demokrasi, bagi saya
sama saja,” tegasnya.
Pertanyaannya, jika ta’rif demokrasi tidak
tunggal, lalu umat Islam harus mengidentifikasikan diri pada makna
demokrasi yang mana, sehingga tidak melanggar syari’at Islam? Kaitannya
dengan kebingungan memilih dan memilah ‘yang ini amal demokrasi’ atau
‘yang itu amal Islami’, sebenarnya tidak sulit. Mereka yang sedikit
memahami ushul fiqh, dapat mengetahuinya melalui kaidah ushuliyah. Dalam
teori ushul fiqih, Imam Syafi’i membuat kategorisasi amal yang disebut “
Anwa’u af’alin Nabiyyi, yaitu
af’alun (perbuatan) Nabi, sebagai barometer amal dibagi tiga bagian:
Pertama, amal yang bersifat
Qurbah, seperti tuntunan ibadah dari Nabi yang tidak boleh di rubah.
Kedua,
Tho’ah,
kehidupan kemanusiaan, yang dibatasi dengan hukum wajib, sunnah, dan
mubah. Contoh, mandi junub. Mandinya sendiri tanpa diatur agama, kita
sudah biasa mandi, dilakukan oleh orang kafir maupun Muslim. Bedanya,
mandi junub bagi orang Islam adalah mandi yang dilakukan setelah
berhubungan seksual dengan istri, perempuan datang haid atau nifas.
Agama yang dibawa Nabi Muhammad menjelaskan itu, maka kita mesti
Tho’ah.
Ketiga, bersifat
Jibillah, perbuatan Nabi yang bersifat naluriah. Dalam hal perbuatan yang bersifat
jibillah prinsipnya adalah mubah, kecuali ada larangan.
Jadi,
tidak perlu bingung, apalagi melakukan sinkretisasi ideologi. Dengan
kategorisasi ini, dimaksudkan agar seorang Muslim dalam menerima atau
menolak sesuatu, bukan karena sesuai atau bertentangan dengan demokrasi;
melainkan selaras dan tidak bertentangan dengan syari’at Islam.
Ketakutan
kelompok liberal akan bahaya menguatnya kekuatan Islam yang dianggap
sebagai ancaman bagi masa depan pluralisme di Indonesia terus diopinikan
dengan resonansi yang kian masif. Sebuah forum yang menyebut dirinya
“Konferensi Nasional Lintas Agama” atau
Indonesian Conference on Religion and Peace
(ICRP) yang dihadiri oleh sekitar 80 peserta ‘tokoh lintas agama dan
kepercayaan’ dari berbagai daerah, dan menolak Perda yang bernuansa
Syariat Islam, memutuskan akan mendesak Pemerintah untuk mencabutnya.
“Kami
akan sampaikan kepada presiden dan wapres yang baru terpilih agar
perda-perda dievaluasi dan bisa masuk ke MK (Mahkamah Konstitusi) atau
Mahkamah Agung (MA) untuk dilakukan judicial review”, ujar ketua forum
yang ternyata seorang Doktor Agama Islam dan PNS di Departemen Agama
RI.” (Harian Surya, Rabu 7/10/09).
Apa yang disebut Perda Syariah
itu? Yaitu, adanya daerah-wilayah di Republik Indonesia ini, di mana
para pejabat legislatif yang beragama Islam membuat kesepakatan untuk
menggoalkan suatu Perda (Peraturan Daerah) yang diinspirasi ajaran
agamanya, yakni Syariat Islam terkait pengelolaan wilayah, (seperti
menolak perjudian, pelacuran, korupsi, dan kemasiatan lain sesuai
tuntunan agama yang dipeluknya). Mereka menggunakan mekanisme yang sudah
sejalan dengan proses pembuatan sebuah perda, termasuk, tentu saja
rapat-rapat di DPRD dengan pihak lain, lalu mereka berhasil menggoalkan
Perda tersebut. Apa yang salah dengan Perda seperti itu?
Sebuah
acara “Nurcholis Madjid Memorial Lecture III” yang digelar di
Universitas Paramadina, Jalan Gatot Subroto, Jakarta Selatan, Rabu
(21/10/09), mengundang Ahmad Syafii Maarif, mantan Ketua Umum PP
Muhammadiyah, untuk menyampaikan orasi ilmiah bertajuk “Politik
Identitas dan Masa Depan Plularisme di Indonesia.”
Dalam
orasinya, Syafii Maarif yang dikenal sebagai kontributor liberalisme
menyinggung soal gerakan-gerakan Islam seperti Majelis Mujahidin
Indonesia (MMI), Front Pembela Islam (FPI) dan Hizbut Tahrir Indonesia
(HTI) yang kerap mengampanyekan penegakan syari’at Islam dan khilafah
Islamiyah.
Syafii menyatakan, “sikap MMI yang menyatakan bahwa
penolakan syari’at Islam secara konsititusional termasuk kategori kafir,
fasik, dan zalim, adalah pernyataan yang berbahaya bagi pluralisme.
Kalau beragama secara hitam putih, mungkin lebih baik saya jadi atheis
saja,” tegasnya.
Dengan menggunakan retorika agitatif, Maarif
menganggap bahwa tuntutan formalisasi syari’at Islam sebagai beragama
hitam putih. Lalu menuduh Majelis Mujahidin (MM) sebagai kelompok takfir
(mengafirkan mereka yang menolak formalisasi syari’at Islam). Sekalipun
Syafii Maarif tidak akan dapat membuktikan tuduhannya terhadap MM
-karena itu bukan sikap MM- tetapi lontaran keji itu sudah menyebar
bagai virus yang melahirkan trauma ukhuwah Islamiyah.
Majelis
Mujahidin tidak pernah merasa paling benar, apalagi mengafirkan Muslim
lainnya. Tetapi tidak membenarkan yang benar adalah kesalahan. Dan tidak
mengatakan kafir terhadap mereka yang dikafirkan oleh Allah dan
Rasul-Nya, adalah kekafiran juga. Maka sikap MM dalam hal ini sesuai
dengan sikap Islam, sebagaimana firman Allah:
“Siapa saja yang tidak berhukum pada hukum Allah adalah kafir, fasik, dan zalim.” (Qs. Al-Maidah, 5: 44, 45, 47).
Dalam beberapa tahun terakhir ini, Syafii Maarif yang tercatat sebagai anggota dari
“Trilateral Commission”
sebuah lembaga yang berada di bawah kendali Zionis, memang dikenal
sebagai orang yang berada dalam gerbong para penolak formalisasi syariat
Islam. Dalam diskusi yang banyak dihadiri para aktivis liberal itu,
Syafii dengan kalimat nyinyir mengatakan, “Kalau kita ingin melaksanakan
syariat Islam secara utuh itu akan sulit hidup dimana saja. Harusnya
kita pakai saja ayat
fattaqullah mastatha’tum, bertakwalah kepada Allah semampumu,” ucapnya.
Dengan
bangga, Syafii bernostalgia, dulu pada tahun 70-an sebelum dirinya
berangkat ke Chicago, Amerika Serikat, dirinya adalah orang yang sangat
anti-terhadap Pancasila. “Tetapi setelah dicuci otak oleh Fazlul Rahman
(Profesor di Chicago) saya berubah,” ujarnya sambil terkekeh. Syafii
mengaku dirinya sedih melihat kondisi bangsa ini, dimana pemerintah
tidak serius dalam mengelola negara. Ia juga sedih melihat kelakuan umat
Islam yang anti terhadap pluralisme dan berupaya memaksakan kehendak
terhadap minoritas. “Kalau tidak sedikit paham Al-Qur’an, mungkin saya
malas jadi orang Islam,” tandas Syafii.
Dalam pandangan Syafii,
formalisasi syari’ah Islam menunjukkan prilaku beragama hitam putih.
Untuk melemahkan tuntutan penegakan syariat Islam, Syafii melakukan
manipulasi sejarah, dan menggiring pemahaman Islam ke arah paham sesat
dan menyesatkan.
Belum lama ini Haedar Nasir menulis buku dan
dibedah bersama Syafii Maarif, untuk menghantam Islam syari’at di
Indonesia. “Gerakan syari’at berangkat dari daerah-daerah menuju ke
pusat. Gerakan ini mengganggu gerakan islam liberal, karena itu gerakan
islam moderat perlu mengantisipasi.”
Apa yang hendak
diantisipaisi dari perjuangan Syari’at Islam? Apakah mereka punya kitab
suci dan nabi yang mengajarkan penolakan terhadap syari’ah Islam? Nabi
Allah yang mana yang mendakwahkan Islam tanpa menegakkan syari’ah Allah?
Sikap mereka dan yang sepaham dengannya, merupakan cermin dari
tokoh-tokoh munafiq di zaman Nabi, pewaris dari sikap tokoh munafiq Ubay
bin Salul.
